The Foundation

The Three Coverage Periods

Uber and Lyft divide their insurance coverage into three "periods" based on the driver's status in the app. The period active at the time of your accident determines which insurance policy applies — and how much coverage is available.

Period 1

App On — No Ride Accepted

Coverage

$50,000 per person / $100,000 per accident / $25,000 property damage

  • Driver has the app open but has not accepted a ride request
  • Uber/Lyft provide contingent liability coverage only
  • Contingent means it only applies if the driver's personal insurance denies the claim
  • Most personal auto policies exclude rideshare activity — so this coverage often does apply
  • No uninsured/underinsured motorist coverage in Period 1

This is the most dangerous coverage gap. Many accidents happen during Period 1 when drivers are cruising for rides.

Period 2

Ride Accepted — En Route to Pickup

Coverage

$1,000,000 liability / $1,000,000 UM/UIM

  • Driver has accepted a ride and is driving to pick up the passenger
  • Full $1M liability policy activates — covers passengers, other drivers, pedestrians
  • $1M uninsured/underinsured motorist coverage also applies
  • This is primary coverage — does not depend on the driver's personal insurance
  • Covers all parties injured in the accident, not just the future passenger
Period 3

Passenger in Vehicle

Coverage

$1,000,000 liability / $1,000,000 UM/UIM

  • Passenger is in the vehicle — from pickup to dropoff
  • Full $1M liability policy applies
  • $1M uninsured/underinsured motorist coverage applies
  • Covers injuries to the passenger, other drivers, and pedestrians
  • This is the strongest coverage tier — most passenger claims fall here

Illinois Law: The Transportation Network Providers Act

Illinois has specific legislation governing rideshare insurance requirements under the Transportation Network Providers Act (625 ILCS 57). This law mandates the coverage tiers described above and provides additional protections for Illinois accident victims.

  • Rideshare companies must maintain the $1M policy during Periods 2 and 3
  • Coverage must be primary — not contingent on the driver's personal insurance
  • Uninsured/underinsured motorist coverage is required during active trips
  • Illinois law prohibits personal auto policies from excluding rideshare activity without notice
